This Privacy Policy explains how the Da India Curry group of restaurants (“we”, “us”, “our”) collects, uses, discloses, and protects personal information when you use our websites and mobile application (collectively, the “Services”). We operate in Saskatchewan, Canada and handle personal information in accordance with applicable Canadian privacy laws.

1. Who We Are

Technology Provider:

Our website ordering and mobile application are provided and operated on our behalf by iOrders Technology Services Inc. (“iOrders”). iOrders acts as our service provider/processor to help us deliver the Services, including order placement, account functionality (if offered), and certain customer support. iOrders may collect, use, store, and disclose personal information only as necessary to provide these services to us and in accordance with this Privacy Policy and our instructions.

2. What Personal Information We Collect

We collect personal information in the following ways:

2.1 Information you provide

  • Contact details (such as name, phone number, email address).
  • Order information (items ordered, preferences, delivery or pickup details, special instructions).
  • Account information (if you create an account), such as login credentials or verification codes.
  • Customer support communications (messages, emails, call notes).
  • Optional information you provide, such as feedback, reviews, or survey responses.

2.2 Information collected automatically

  • Device and usage data (such as device type, operating system, app version, pages/screens viewed, crash logs).
  • Approximate location derived from your device or IP address (for example, to show the nearest location).

2.3 Information from third parties

We may receive limited information from service providers that help us operate the Services (for example: payment confirmations from payment processors, delivery status from delivery partners, or analytics reports).

Withdrawing consent may limit our ability to provide certain Services (for example, delivering an order without an address).

  • Our restaurant locations and staff to fulfill your order and provide customer service.
  • Payment processors and financial institutions to process transactions (we do not receive or store full card numbers).
  • Delivery partners and logistics providers to deliver your order, if delivery is selected.
  • Technology service providers that help us run the Services, including iOrders Technology Services Inc. (ordering platform and mobile app), hosting providers, analytics and error monitoring vendors, messaging/email/SMS providers, and customer support tools.
  • Professional advisors (such as auditors, insurers, or legal counsel) as needed.
  • Law enforcement or regulators where required or permitted by law (for example, to respond to lawful requests or protect rights and safety).
  • A successor entity in the event of a business transaction (such as a merger, sale, or reorganization), subject to appropriate safeguards.

We do not sell your personal information. If we ever share information for targeted advertising that constitutes “tracking” under platform rules, we will provide required disclosures and obtain consent where applicable.

6. Marketing Communications (Email/SMS)

If you opt in to receive marketing communications (for example: promotions, coupons, or news), we will send them in accordance with applicable Canadian anti-spam laws. You can unsubscribe at any time using the link in an email or by following the instructions in an SMS message. Even if you unsubscribe from marketing messages, we may still send you transactional messages about your orders.

7. Cookies and Analytics

Our websites may use cookies and similar technologies to enable core functionality (such as maintaining your session), to remember preferences, and to understand how the Services are used. You can control cookies through your browser settings; however, disabling cookies may affect functionality.

8. Location Services

If you enable location permissions on your device, the app may collect precise location information to help you select the nearest location or support delivery features. You can disable location permissions in your device settings.

9. Payments

Online payments are processed by third-party payment processors. Payment information you provide is handled according to the processor’s terms and privacy policy. We may receive transaction confirmations and limited details needed for order management, accounting, and dispute handling.

We retain personal information only as long as necessary to fulfill the purposes described in this Privacy Policy, to meet legal or accounting requirements, and to resolve disputes. Retention periods may vary depending on the type of information and the context.

11. Safeguards

We use administrative, technical, and physical safeguards appropriate to the sensitivity of the information. No method of transmission or storage is completely secure; however, we take reasonable steps to protect personal information from loss, theft, unauthorized access, disclosure, copying, use, or modification.

12. Access, Correction, and Other Rights

You may request access to the personal information we hold about you and request corrections if it is inaccurate or incomplete. To make a request, contact our Privacy Officer using the details in Section 1. We may need to verify your identity before responding.

13. Cross-Border Processing

Some of our service providers may process or store information outside Canada. If personal information is processed outside Canada, it may be subject to the laws of the jurisdiction where it is processed. We require service providers to protect personal information with appropriate safeguards.

14. Children’s Privacy

The Services are not directed to children and are intended for general audiences. We do not knowingly collect personal information from children. If you believe a child has provided personal information through the Services, contact us so we can take appropriate steps.

15. App Store and Google Play Disclosures

To comply with platform requirements, we provide app privacy disclosures (such as Apple “App Privacy” details and Google Play “Data safety” information) in the app store listing. Those disclosures are based on our current data practices and are updated when our practices change.

We may update this Privacy Policy from time to time. If we make material changes, we will post the updated policy through the Services and update the “Last Updated” date.
